The trial was presided over by the Honorable William S. Pocan in Milwaukee County Circuit Court located in Milwaukee, Wisconsin. Attorney Nick Hermann and Steven Gruber represented our client in trial against Progressive Insurance Company. This was an important case against Progressive Insurance.

The case involved a collarbone injury among other injuries. Notably, Progressive made an Offer of Settlement before trial of $15,000 blaming our client for being at-fault, as well as arguing the injuries and pain and suffering were not as severe as our team believed. During the trial Progressive made a few increased settlement offers.

The Trial

Nick Hermann handled the opening statements, rebuttal and some witness testimony. Attorney Steve Gruber also handled witness testimony, as well as the closing argument. The case involved disagreement over both liability and damages. We entered into a high/low arrangement depending on the verdict results the morning of closing arguments. Ultimately, the jury deliberated for four hours, and the verdict came back at approximately $238,000! The jury assessed 65% comparative negligence on the defendant and 35% on our client.
