Changes in the Law
Great inroads were made in 2009 in Wisconsin when new auto insurance laws went into effect that helped consumers. Auto insurance was made mandatory. Minimum limits were increased to $50,000 per person and $100,000 per accident. Consumers were permitted to stack insurance policies on multiple vehicles which allowed for increased coverage in the event the limits of one policy were not sufficient to fully compensate someone for their injuries.
However, the laws are again changing. As of November 1, 2011, mandatory auto insurance limits in the State of Wisconsin will be cut in half and stacking will no longer be permitted. There are other changes in the new law that consumers should be aware of when purchasing auto insurance and speaking with their agents.
MINIMUM LIMIT REQUIREMENTS REDUCED
In 2010, Wisconsin began requiring auto owners to carry auto insurance. Wisconsin also raised the minimum limits that drivers are required to carry to $50,000 for each person and $100,000 per accident.
The new law, which will take effect as of November 1, 2011, will reduce the minimum limits that drivers must now carry to $25,000 per person and $100,000 per accident.
UNINSURED MOTORIST COVERAGE
Uninsured motorist coverage is required in Wisconsin. It covers you in the event the person who hit you does not have any insurance. Current law requires auto insurance policies to provide uninsured motorist coverage with minimum limits of $100,000 per person and $300,000 per accident. The new law, effective November 1, 2011, will still require drivers to have uninsured motorist coverage. However, the limits will be drastically reduced to $25,000 per person and $50,000 per accident.
UNDERINSURED MOTORIST COVERAGE
Underinsured motorist coverage covers you in the event the person who hit you has insurance but it is not enough to compensate you for your injuries. Current law requires auto insurance policies to provide underinsured motorist coverage. However, with the changes in the law effective November 1, 2011, drivers are no longer required to carry underinsured motorist coverage. It must be offered by an insurance company, but a vehicle owner can reject it in writing. You should not reject this coverage. It is an important way to help protect you and your family if you are injured in an accident. The minimum underinsured motorist limits are being reduced to $50,000 per person and $100,000 per accident.
REDUCING CLAUSES AND ANTISTACKING
The new law, effective November 1, 2011, will allow insurance companies to reduce uninsured and underinsured motorist coverage by amounts paid by anyone else that may be legally responsible for the injuries, including worker’s compensation and disability benefits. This may result in having less insurance coverage available to you than you thought you were purchasing.
The new law also permits insurance companies to including “antistacking” provisions that limit the number of policies that insure vehicles that can be stacked together to give you more coverage. Under the old law, the maximum number of vehicles that can be stacked is three. Under the new law, effective November 1, 2011, there is absolutely no stacking of insurance coverages.
HOW CAN I MAKE SURE I AM PROTECTED IN CASE OF AN ACCIDENT
It is extremely important to have all four types of possible auto insurance coverage:
- Liability coverage protects you if you cause an accident.
- Medical payments coverage helps cover medical bills
- Uninsured coverage protects you if the other driver does not have insurance
- Underinsured coverage protects you if the other driver doesn’t have enough
- Protect yourself, your family and your loved ones. Call your agent to make sure you are fully protected.
